EU Council Releases Compromise Text for Draft Toy Safety Regulation
GENEVA, SWITZERLAND / AGILITYPR.NEWS / July 16, 2025 / SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 098.25 to provide an overview of the recent compromise text issued by the Council of the European Union for the draft Toy Safety Regulation (TSR).
The draft TSR replaces the current Toy Safety Directive (2009/48/EC) and introduces major regulatory changes aimed at improving safety and addressing new technological and chemical risks. Among the key updates are the replacement of the EU declaration of conformity with a digital product passport (DPP), classification of AI-enabled toys as high-risk AI systems and enhanced obligations for manufacturers, fulfilment service providers and online marketplaces.
Additional significant provisions include the introduction of new chemical restrictions covering PFAS, nitrosamines, bisphenols and other hazardous substances, along with stricter requirements to prevent risks related to choking hazards, noise emissions and magnetic components in toys.
The regulation also mandates improved consumer complaint processes, new definitions relating to the DPP and the Commission’s role in issuing guidelines to support SMEs. The draft TSR is set to repeal the existing Toy Safety Directive 54 months after its entry into force, with a 30-month transition period for compliance.
